Confidentiality Agreement

The User agrees not to disclose to third parties, the “Confidential Information”, received through the web site www.safaricrowdfunding.com (hereinafter the Web). “Confidential Information” includes all information disclosed in oral, visual, written, recorded magnetic media or any other tangible form and that is clearly marked as such when delivered to the User. It is essential that strict confidentiality be observed for non exclusive examples, information subject to copyright, patents, techniques, models, inventions, know-how, processes, algorithms, programs, executable, research, design details, financial information, customer lists, investors, employees, business and contractual relationships, business forecasts, marketing plans or other information revealed about third persons.

The User agrees not to disclose "confidential information" to third parties, without the prior written consent of Safari.

The User agrees that "Confidential Information" received from Safari is and will remain the property of Safari or the project designer. The user further agrees to use this information only in the manner and for the purposes authorized. Use of the Website, and acting as Investor does not constitute a right to any intellectual property, including, without limitation, any license regarding the "Confidential Information".

The User agrees that in the event that part or all of the obligations derived from the confidentiality agreement are breached, the User shall be liable for any damages such breach might cause Safari or Project Designer.

Notwithstanding the provisions of this agreement, the User will have no obligation to keep confidential any information that is or becomes part of the public domain or ceases to be confidential as a result of disclosure by the owner of the project.

The terms of this agreement will remain in effect indefinitely and while the User is registered as such in the Safariweb.

The obligations under this agreement to the User with respect to the confidentiality of "confidential information" and to the use thereof, shall survive the termination, for a period of at least 2 (two) years from such termination.
